Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Velvet Reel website at velvetreel.lumiality.com (the "Site") or engaging Velvet Reel ("we," "us," or "our") for any creative services.
1. Acceptance of Terms
By accessing the Site or enquiring about our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
2. Services
Velvet Reel provides cinematic book trailers, visual campaigns, motion assets, and related creative production services for authors, publishers, and associated creative professionals. The specific scope, deliverables, timeline, and pricing for each project are agreed upon separately in a written project agreement or statement of work ("Project Agreement").
3. Project Agreements and Payment
- All projects require a signed Project Agreement before work commences.
- A non-refundable deposit (as specified in the Project Agreement) is due upon signing.
- Remaining balances are due on the schedule set out in the Project Agreement.
- Work will not be delivered until all outstanding payments have been received.
- Prices are quoted in the currency stated in the Project Agreement and are exclusive of any applicable taxes unless stated otherwise.
4. Revisions and Scope Changes
The number of included revisions is defined in the Project Agreement. Requests beyond that scope, or material changes to the project brief after production has begun, may incur additional charges and timeline adjustments, which will be agreed upon in writing before proceeding.
5. Intellectual Property
Client-supplied materials
You warrant that you own or have the necessary licences for all materials (text, images, audio, trademarks, etc.) you supply to us. You grant us a limited licence to use these materials solely for the purpose of completing your project. You are responsible for ensuring that supplied materials do not infringe third-party rights.
Deliverables
Upon receipt of full payment, and subject to the terms of the Project Agreement, we assign to you the agreed rights in the final deliverables. Unless the Project Agreement specifies a full copyright transfer, we retain ownership of underlying techniques, tools, templates, and raw project files. We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
Site content
All original text, graphics, videos, and other content on this Site are owned by or licenced to Velvet Reel. You may not reproduce, distribute, or create derivative works without our prior written consent.
6. Cancellations
If you cancel a project after signing, the deposit is non-refundable. If significant production work has already been completed, additional fees may apply as specified in the Project Agreement. We reserve the right to cancel a project if payment obligations are not met; in that case, rights to any deliverables do not transfer.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Velvet Reel shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or our services, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the total fees paid by you for the specific project giving rise to the claim.
8. Warranties and Disclaimers
We endeavour to deliver high-quality creative work, but we make no warranties that deliverables will achieve specific commercial outcomes (e.g., book sales, streaming numbers, or advertising performance). The Site and its content are provided "as is" without warranties of any kind.
9. Third-Party Links and Content
The Site may contain links to third-party websites. These links are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices, or accuracy of any third-party site.
10. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Velvet Reel is registered, without regard to its conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise agreed in writing.
12. Changes to These Terms
We may revise these Terms at any time. The "Effective date" above reflects the latest update. Continued use of the Site or our services after changes constitutes your acceptance of the revised Terms.
